Recruitment services are governed separately
Nothing on this website sets the terms of any recruitment work. Solvism recruitment services are governed by a separate Terms and Conditions, provided to clients on engagement. Those terms, and not this page, decide the rights and obligations of a recruitment assignment. The shape of what a client agrees to includes:
- Assignments are accepted on an exclusive basis, unless agreed otherwise in writing.
- A candidate counts as introduced from the moment Solvism sends identifying information about them, and the fee is due if that candidate is engaged within twelve months, directly or through an affiliated company.
- The fee is still due for a candidate the client already knew, unless the client said so in writing before the introduction.
- Telling a candidate what Solvism is being paid carries a contractual penalty per occurrence, and if a confidentiality breach leads to the candidate being engaged elsewhere the full fee is still owed.
- Failing to tell Solvism about an appointment within fourteen days of the start date carries a penalty on top of the fee.
- Breaching the terms generally carries a penalty per occurrence, plus a further penalty for each day it continues.
- Invoices are payable within fourteen days.
- Guarantee: if the employment contract ends within four weeks of starting, Solvism looks for a replacement free of charge for three months, and refunds the fee already paid if it does not find one, except that under the fixed-fee model the start fee is not refundable. The guarantee lapses where the role changed, where the ending was for reorganisation or business reasons, or where the client caused it.
- Liability is limited to the fee Solvism received for that assignment, and covers direct damage only.
- A claim lapses six months after the event that caused it.
- Dutch law, court of The Hague. The terms are filed with the Chamber of Commerce in The Hague.
This list gives the shape of the obligations, not the exact wording. The filed document itself is provided to every client before an assignment starts.
Governing law
These terms are governed exclusively by the law of the Netherlands. Any dispute about them or about your use of this site will be submitted to the court of Den Haag.
